5.4 Pre-Opening Assistance.
- (a) Selecting Location. Franchisor shall provide its criteria for Endless Summer Sweets locations to Franchisee. Franchisor will review and advise Franchisee regarding potential locations submitted by Franchisee.
- (b) Pre-Opening Plans, Specifications, and Vendors. Within a reasonable period of time after the Effective Date, Franchisor shall provide Franchisee with (i) Franchisor's sample set of standard building plans and specifications and/or standard recommended floor plans; (ii) the applicable System Standards, (iii) other specifications as Franchisor deems appropriate (which may include specifications regarding inventory, supplies, materials, and other matters), and (iv) Franchisor's lists of Approved Vendors and/or Required Vendors.
- (c) Pre-Opening Training. Franchisor shall make available its standard pre-opening training to Franchisee's Principal Executive and up to one additional person, at Franchisor's headquarters and/or at another location designated by Franchisor. Franchisor shall not charge any fee for this training. Franchisee is responsible for its own travel, lodging, meal, and other out-ofpocket expenses. Franchisor reserves the right to vary the length and content of the initial training program based on the experience and skill level of any individual attending the program.
- (d) Market Introduction Plan. Franchisor shall advise Franchisee regarding the planning and execution of Franchisee's market introduction plan.
(e) On-Site Opening Assistance. Franchisor shall have a representative support Franchisee's business opening with up to five days of onsite training and assistance around the time of opening.

According to the 2024 Endless Summer Sweets Franchise Disclosure Document, before opening their business, franchisees must meet several conditions. Endless Summer Sweets will provide its criteria for locations and advise franchisees on potential sites. Franchisees must ensure they purchase or lease all necessary equipment to accept payments as required by Endless Summer Sweets and comply with payment card industry data security standards (PCI-DSS). The franchisee's Principal Executive, along with one additional person, can attend pre-opening training provided by Endless Summer Sweets at their headquarters or another designated location without incurring a training fee, though they are responsible for their own travel and lodging expenses.
Endless Summer Sweets will advise franchisees on planning and executing their market introduction plan. Additionally, Endless Summer Sweets will have a representative provide up to five days of on-site training and assistance around the time of the business opening. For California franchisees, the collection of initial fees is deferred until all pre-opening obligations are completed and the business is open.
