What This Means (2024 FDD)

According to Endless Summer Sweets' 2024 Franchise Disclosure Document, a franchisee must obtain prior written approval from the company before using any unapproved advertising or promotional materials that bear the Endless Summer Sweets name, trademarks, or any proprietary elements. If Endless Summer Sweets does not approve the materials within 14 days, they are considered disapproved.

The FDD states that franchisees are required to spend 3% of their gross sales per month on advertising and promotional activities, using types that Endless Summer Sweets approves or as described in the Operations Manual. Franchisees must also provide an accounting of their local advertising expenditures and documentation of their promotional activities to Endless Summer Sweets by February 28th of each year. If a franchisee fails to spend the required minimum amount on approved local advertising, they must pay the difference to Endless Summer Sweets.

Endless Summer Sweets retains the right to stop any marketing, advertising, or promotion at any time. All marketing materials must depict the trademarks only in connection with the sale of approved services and products and must be current, in good taste, and in good condition, reflecting the brand's established position and character. This level of control is typical in franchising, as franchisors need to protect their brand image and ensure consistent messaging across all locations.
