Can Endless Summer Sweets change, add, or delete System Standards at any time?

According to Endless Summer Sweets' 2024 Franchise Disclosure Document, Endless Summer Sweets has the right to modify the System Standards at any time. The franchise agreement states that no modification or amendment of the agreement will be effective unless it is in writing and signed by both parties. However, this provision does not limit Endless Summer Sweets' rights to modify the Manual or System Standards.

System Standards are defined in the FDD as the then-current mandatory procedures, requirements, and/or standards of the System as determined by Endless Summer Sweets. These standards may include procedures, requirements, and/or standards for various aspects of the business, such as appearance, business metrics, cleanliness, customer service, design, equipment, inventory, marketing and public relations, operating days, operating hours, presentation of Marks, product and service offerings, quality of products and services, reporting, safety, and technology.

This means that as an Endless Summer Sweets franchisee, you must adhere to the System Standards, and Endless Summer Sweets can change these standards during the term of the franchise agreement. These changes could impact various aspects of your business operations, and you would be required to implement them. While the franchise agreement itself requires written consent for modifications, the System Standards and Manual can be changed by Endless Summer Sweets without requiring your explicit consent.
