HSS has no obligation to maintain or repair any software other than the Proprietary Software or PEP, nor to repair or replace any expendable or consumable components such as ribbons, paper, toner cartridges, print wheels, drums, batteries, or diskettes.

According to the 2025 Embassy Suites By Hilton Franchise Disclosure Document, HSS (presumably a software vendor) is primarily responsible for maintaining and repairing the "Proprietary Software" and PEP (likely an associated platform or system). However, HSS has no obligation to provide maintenance, support, or help desk services for any "Certified Third Party Software," as this support is provided by preferred providers under separate agreements.
HSS will supply standard enhancements, improvements, updates, and modifications to the Proprietary Software and PEP, provided the franchisee has paid all required fees and met their obligations. These updates become HSS's property. The franchisee may be required to purchase certain updates to the Proprietary Software and PEP separately, along with additional hardware or software to utilize major upgrades.
HSS is not obligated to maintain or repair any software other than the Proprietary Software or PEP. If a franchisee uses any non-certified third-party software on the authorized equipment, HSS is relieved of its maintenance obligations for the Proprietary Software. The franchisee is also responsible for maintaining trained personnel to use the information system and for keeping backup copies of their software and data.
