What This Means (2025 FDD)
According to Embassy Suites By Hilton's 2025 Franchise Disclosure Document, the Construction Commencement Date is specified in the Addendum or any Property Improvement Plan (PIP). For certain brands under Hilton, including Embassy Suites By Hilton ('CI DT ES GU HFS OL PY QQ UP'), the Construction Commencement Date is due sixteen (16) months from the Effective Date.
The Effective Date is defined as the date set out in the Addendum on which the franchise agreement becomes effective. Therefore, the Construction Commencement Date is directly tied to this Effective Date, which is specific to your franchise agreement.
The FDD also stipulates conditions for a hotel to be considered under construction. These include submitting final plans, receiving approval for those plans, submitting a building permit, and substantially completing exterior and interior demolition and construction of new permanent interior walls to the franchisor's satisfaction. It is important to note that the Construction Commencement Date may be extended by thirty (30) days on a rolling basis unless Embassy Suites By Hilton provides at least sixty (60) days' notice that these automatic extensions no longer apply.
