What This Means (2025 FDD)

According to Embassy Suites' 2025 Franchise Disclosure Document, Embassy Suites may not approve the opening of a hotel if the hotel is not compliant with the Americans with Disabilities Act (ADA). Before Embassy Suites permits construction or remodeling plans to proceed, the franchisee's architect or certified professional must certify that the hotel's plans comply with all laws related to accessibility for those with disabilities.

Within 30 days of Embassy Suites' request, the franchisee may be required to complete an ADA survey with an approved ADA consultant to determine ADA compliance. If the hotel does not comply with the ADA, the franchisee must submit a plan to the ADA consultant detailing how the hotel will be brought into compliance, according to the process outlined in the Manual.

Both the franchisee and their architect or general contractor must provide Embassy Suites with a certificate stating that the plans and premises comply with all applicable legal requirements relating to accessibility for those with disabilities before the hotel opens for business. This requirement ensures that all Embassy Suites hotels meet the necessary standards for accessibility, protecting both the brand's reputation and the rights of guests with disabilities. Failure to comply with ADA regulations can result in significant legal and financial repercussions for the franchisee.
