Except as described in the following sentence, you may not conduct or permit the sale of timeshares, vacation ownership, fractional ownership, condominiums or like schemes at or adjacent to your Hotel without our written permission, you may do so only as we permit and we may withhold permission at our sole discretion. You may conduct timeshare or condominium sales or marketing at any property that you own or lease which is located adjacent to the hotel so long as you do not use any of the Marks in these sales efforts and you do not use the hotel or its facilities in these timeshare or condominium sales, marketing efforts or business operations.

What This Means (2025 FDD)
According to Embassy Suites's 2025 Franchise Disclosure Document, franchisees generally need written permission from the franchisor to conduct or permit the sale of timeshares, vacation ownership, fractional ownership, condominiums, or similar schemes at or adjacent to their hotel. This permission can be withheld at Embassy Suites's sole discretion.
However, an Embassy Suites franchisee may conduct timeshare or condominium sales or marketing at a property they own or lease that is located adjacent to the hotel under specific conditions. These conditions stipulate that the franchisee must not use any of Embassy Suites's trademarks or service marks in these sales efforts.
Furthermore, the franchisee cannot use the Embassy Suites hotel or its facilities in any way to support these timeshare or condominium sales, marketing efforts, or business operations. This exception allows franchisees to engage in adjacent real estate sales without directly associating those activities with the Embassy Suites brand or diverting hotel resources.
