Answer from 2025 FDD Document

If requested, you must arrange for us and/or our affiliates to participate in all progress meetings during the development and construction of the hotel, to have access to all contract and construction documents for the hotel and to have access to the hotel during reasonable business hours to inspect the hotel and its construction, completion, furnishing and equipment for conformity to the finally-approved construction documents. What This Means (2025 FDD)

According to Embassy Suites's 2025 Franchise Disclosure Document, while the franchisee may request Embassy Suites and its affiliates to participate in all progress meetings during the hotel's development and construction, Embassy Suites has no obligation to do so. The franchisee must also provide access to all contract and construction documents and allow access to the hotel for inspection to ensure conformity to approved construction documents. However, Embassy Suites's approval does not guarantee the adequacy of the plans, structural integrity, or sufficiency of mechanical and electrical systems.

This means that while Embassy Suites has the right to be involved in the construction process to ensure brand standards are met, they are not required to participate in progress meetings or conduct inspections. The franchisee bears the primary responsibility for ensuring the hotel is built according to approved plans and complies with all applicable laws, including accessibility requirements.

This arrangement places the onus on the franchisee to manage the construction process effectively and proactively address any issues that may arise. It is crucial for prospective Embassy Suites franchisees to engage qualified professionals, such as architects and contractors, and to diligently oversee the construction to meet brand standards and legal requirements. Failing to comply with ADA standards may result in Embassy Suites not approving the hotel's opening.
