tions or seeking expenses, losses or damages caused thereby. Finally, Franchisee expressly waives any claims, demands or damages arising from or related to the foregoing activities including, without limitation, any claim of breach of contract, breach of fiduciary duty, fraud, and/or breach of the implied covenant of good faith and fair dealing.
- 7.15 Variance. Franchisor has the right to vary standards or specifications for any franchisee based upon that particular franchisee's qualifications, the peculiarities of the particular site or circumstances, the demographics of the trade area, business potential, existing business practices or any other condition which Franchisor deems to be of importance to the successful operation of any particular Ella Coffee Company Franchise Business. Franchisor shall not be required to disclose or grant to Franchisee a like or similar variance hereunder.
- 7.16 Days of Operation. Franchisee shall keep the Franchised Business open for business at least 10 hours per day seven days per week, excluding major holidays, up to three holidays per year, as specified and amended from time to time in the Confidential Operations Manual.
