What This Means (2024 FDD)
According to Ella Cafe's 2024 Franchise Disclosure Document, the Lease Rider attached as Attachment 7 to the Franchise Agreement grants specific rights to Ella Cafe. While Ella Cafe does not review the lease terms for the Coffee House location, they require that the landlord acknowledges their rights as outlined in the Lease Rider. Ella Cafe retains the right to disapprove a proposed lease if the landlord refuses to sign the Lease Rider in substantially the form provided in Attachment 7.
The Lease Rider grants Ella Cafe the right to be notified if the franchisee defaults on the lease. This notification allows Ella Cafe to stay informed about potential issues that could affect the operation of the franchise.
Furthermore, the Lease Rider potentially grants Ella Cafe the right to enter the premises of the Coffee House. This provision could be crucial for Ella Cafe to protect its brand and ensure compliance with franchise standards, especially if the franchisee is not fulfilling their obligations. It is important for a prospective franchisee to carefully review Attachment 7 to fully understand the conditions under which Ella Cafe can exercise this right of entry.
