What This Means (2024 FDD)
According to Ella Cafe's 2024 Franchise Disclosure Document, the franchisee is responsible for obtaining the necessary permits, certificates, or licenses for the lawful operation of their Coffee House. The franchisee must also operate the Coffee House according to the highest applicable health standards and ratings. This includes complying with Ella Cafe's operating methods, standards, and specifications, and maintaining a high moral and ethical standard.
This means that a prospective Ella Cafe franchisee will need to navigate the local regulatory environment to ensure their business is fully compliant with all applicable laws and standards. Failing to obtain the required permits and licenses can result in fines, penalties, or even the closure of the business.
Furthermore, the franchisee is responsible for ensuring that the Coffee House is designed, constructed, and altered in compliance with the Americans With Disabilities Act of 1990 (ADA) and all applicable state or local laws regarding public accommodations for disabled persons. The franchisee must provide evidence of this compliance to Ella Cafe and indemnify Ella Cafe against any claims arising from non-compliance. This highlights the importance of understanding and adhering to all regulatory requirements, including those related to accessibility, to avoid potential legal and financial repercussions.
