Does Ella Cafe provide standard building plans and specifications for the Coffee House?

According to Ella Cafe's 2024 Franchise Disclosure Document, Ella Cafe may provide standard building plans and specifications or recommended floor plans and required décor for the Coffee House. The franchisee is obligated to follow Ella Cafe's procedures for Coffee House construction and build-out, which include engaging an architect, design consultant, and/or general contractor that Ella Cafe specifies.

If a franchisee requests that Ella Cafe approve any vendor to provide services required to complete the construction of the Coffee House, which vendor is not on Ella Cafe's approved vendor list, Ella Cafe has the option to approve or disapprove the vendor. Once the franchisee's site is approved, Ella Cafe is not responsible for any construction delays due to change orders, events of Force Majeure, disputes with landlords, architects, contractors, subcontractors, or any other vendor, or due to any other action or reason occurring during build-out of the Coffee House.

Furthermore, the franchisee is responsible for ensuring the Coffee House is designed, constructed, and altered in compliance with the Americans With Disabilities Act of 1990 and all other applicable laws and regulations concerning public accommodations for disabled persons. The franchisee must furnish evidence satisfactory to Ella Cafe that the Coffee House meets these requirements and must indemnify Ella Cafe against any claims arising from the franchisee's failure to comply with these obligations.
