Who owns the customer data generated by an Ella Cafe Business?

According to Ella Cafe's 2024 Franchise Disclosure Document, all customer data generated or obtained by the franchisee is considered confidential information and belongs to Ella Coffee Company or its affiliates. This includes any data collected through the point-of-sale (POS) systems, customer loyalty programs, or other means. This stipulation remains in effect even after the termination or expiration of the Franchise Agreement.

This means that while franchisees collect the data, they do not own it and must adhere to Ella Coffee Company's security procedures for maintaining its confidentiality. Franchisees can only use the data to the extent necessary for operating their Ella Cafe business and as specifically authorized by Ella Coffee Company in writing. They are prohibited from using the data for any other business or unauthorized purpose.
