out-of-pocket expenses for its personals for attending the training. Franchisor reserves the right to vary the length and content of the initial training program based on the experience and skill level of any individual attending the program.

  • 5.3. Opening Assistance. In conjunction with the beginning of operation of the Franchised Business, Franchisor shall make available to Franchisee, at Franchisor's expense, one of Franchisor's representatives in person or virtual at sole discretion of the Franchisor, experienced in the System, for the purpose of familiarizing Franchisee's staff with the ELLA Coffee House techniques and for the purpose of providing general assistance and guidance in connection with the opening of the Franchised Business. If Franchisee requests additional assistance with respect to the opening or continued operation of the Franchised Business, and should Franchisor deem it necessary and appropriate in its sole discretion, Franchisee shall pay Franchisor's then-current standard rates, plus expenses, for such additional assistance.

5.4. Additional and/or Remedial Training.

  • 5.4.1. Franchisee will cause its Principal Executive, and other employees that Franchisor designates to attend such additional courses, seminars, and other training programs which may be offered in various formats, including but not limited to, third-party providers, online training, regional meetings or seminars, traditional classroom training, and programs offered at Franchisor's Conference. Franchisor or third-party providers may charge tuition for such additional courses, seminars, or other training programs, and Franchisee is responsible for all training-related costs and expenses including, without limitation, tuition/attendance fees, salary, travel, lodging, and dining costs for all of Franchisee's attendees who participate in the training.

According to Ella Cafe's 2024 Franchise Disclosure Document, Ella Cafe provides some opening assistance but is not obligated to provide in-person support. Specifically, Ella Cafe will make available one of its representatives, either in person or virtually at Ella Cafe's sole discretion, to help familiarize the franchisee's staff with Ella Coffee House techniques and provide general assistance during the opening.

However, if a franchisee requests additional assistance with the opening or continued operation of the franchised business, Ella Cafe has the sole discretion to determine if it is necessary and appropriate to provide such assistance. If Ella Cafe deems additional support is needed, the franchisee will be responsible for paying Ella Cafe's then-current standard rates, plus expenses, for the extra help.

Furthermore, the FDD states that Ella Cafe is not obligated to provide any training or assistance to the franchisee's particular level of satisfaction. The level of support is based on Ella Cafe's experience, knowledge, and judgment. Ella Cafe is also not obligated to provide any services to the franchisee that are not explicitly outlined in the franchise agreement. If a franchisee believes that Ella Cafe has failed to adequately provide pre-opening services, they must notify Ella Cafe in writing within 30 days of opening their Ella Coffee House franchise. Otherwise, it will be assumed that all pre-opening and opening services were sufficient and satisfactory.
