What This Means (2024 FDD)
According to Ella Cafe's 2024 Franchise Disclosure Document, franchisees must maintain cyber insurance with a minimum coverage of $1,000,000. This insurance is intended to protect against both first-party and third-party claims.
In practical terms, this means that an Ella Cafe franchisee needs to secure a cyber insurance policy that can cover at least $1,000,000 in damages and legal costs resulting from cyber incidents. These incidents could include data breaches, hacking, or other cyberattacks that compromise sensitive information or disrupt business operations. The policy should cover claims made both by the franchisee (first-party) and by customers or other parties affected by the cyber incident (third-party).
Cyber insurance is increasingly important for businesses, especially those that handle customer data or rely heavily on technology. The $1,000,000 minimum coverage requirement reflects the potential costs associated with a significant cyber event, including legal fees, investigation expenses, customer notification costs, and potential settlements or judgments. It is important for prospective franchisees to factor in the cost of this insurance when evaluating the overall financial investment required to start and operate an Ella Cafe franchise.
Ella Cafe allows franchisees to purchase insurance from any vendor, provided the insurance company is licensed in the state where the franchise operates and has an "A" Rating Classification as indicated in the latest issue of A.M. Best's Key Rating Guide. Franchisees must also name Ella Coffee Company, LLC as an additional insured on any insurance policies and furnish proof of insurance before beginning operation of their Coffee House.
