There are no currently effective material determinations of the United States Patent and Trademark Office, the Trademark Trial and Appeal Board, or any state trademark administrator or court. Other than as stated below there are no pending infringement, opposition, or cancellation proceedings.
Opposition
There is currently an opposition pending with the Trademark Trial and Appeal Board. We dispute the validity of this opposition and find the filing has no merit. We will respond timely in defense of our position. Other than as disclosed, there is no pending material federal or state court litigation regarding our use or ownership rights in a trademark.
We do not know of either superior prior rights or infringing uses that could materially affect your use of the principal trademarks.

What This Means (2024 FDD)
According to Ella Cafe's 2024 Franchise Disclosure Document, there are no currently effective material determinations from the United States Patent and Trademark Office, the Trademark Trial and Appeal Board, or any state trademark administrator or court regarding their trademarks. However, there is one opposition proceeding currently pending with the Trademark Trial and Appeal Board. Ella Cafe disputes the validity of this opposition.
The FDD states that Ella Cafe is not obligated to protect a franchisee's right to use the marks or protect them against claims of infringement or unfair competition. However, Ella Cafe may, at its sole discretion, protect a franchisee's right to use the principal trademarks and defend against claims of infringement or unfair competition.
As an Ella Cafe franchisee, you must immediately notify Ella Cafe of any infringement of the Marks or any challenge to the use of any of the Marks or claim by any person of any rights in any of the Marks. Franchisees must agree not to communicate with any person other than Ella Cafe, any designated affiliate, and their counsel about any infringement, challenge, or claim. Ella Cafe has sole discretion to take any action it deems appropriate and the right to exclusively control any litigation or Patent and Trademark Office (or other) proceeding from any infringement, challenge, or claim concerning any of the Marks.
The franchisee must execute all instruments and documents and give Ella Cafe any assistance that, in their counsel's or their affiliates' counsel's opinion, may be necessary or advisable to protect and maintain their interests or those of their affiliates in any litigation or proceeding or to otherwise protect and maintain their or their interest in the Marks. Franchisees may use only the Marks that Ella Cafe designates, must use them only in the manner that they authorize and permit, and must use them with the symbols, "®", "™", or "SM", as appropriate.
