What This Means (2024 FDD)
According to the 2024 Dryer Vent Squad Franchise Disclosure Document, specific actions are required upon termination of a Dryer Vent Squad franchise, focusing on de-identification of the former business.
The franchisee must modify their former Dryer Vent Squad business and administrative office as required by Dryer Vent Squad to ensure it is completely de-identified to avoid public confusion. This includes removing all distinctive physical and structural features, signs, trade dress, and emblems associated with the Dryer Vent Squad system, including those bearing the licensed marks. Dryer Vent Squad may request additional changes to further de-identify the former business.
The franchisee must immediately begin these actions and complete them within the timeframe designated by Dryer Vent Squad. Dryer Vent Squad or its agents may enter the premises to make these alterations at the franchisee's expense if the franchisee fails to do so in a timely manner. Failure to make these changes can cause irreparable injury to Dryer Vent Squad, and the franchisee consents to a court order allowing Dryer Vent Squad to take action at the franchisee's expense. Additionally, the franchisee must take all necessary actions to cancel any assumed names or registrations related to the licensed marks.
These requirements ensure that a terminated Dryer Vent Squad franchise cannot continue to operate in a way that would confuse customers or infringe on Dryer Vent Squad's brand and trademarks. This protects the integrity of the Dryer Vent Squad brand and prevents unfair competition from former franchisees.
