What This Means (2024 FDD)
Based on the 2024 Dryer Vent Squad Franchise Disclosure Document, the document includes an 'Owner Agreement and Individual Guaranty' as Exhibit 1. This agreement is entered into by the owner of the franchisee in favor of DVS Holdings, Inc., the franchisor. The agreement is signed by the owner, committing to the terms and conditions outlined within. The document states that the franchisee has entered into a Dryer Vent Squad Business Franchise Agreement for operating a business that offers cleaning, repair, and maintenance services for dryer vents under the Licensed Marks.
The FDD emphasizes that the owner has thoroughly reviewed the Franchise Agreement, including all schedules and exhibits, and that Dryer Vent Squad recommended they review the agreement with a lawyer. This suggests the importance of understanding the obligations and potential liabilities associated with the guaranty. The document does not explicitly state whether the personal guaranty is revocable.
Because the excerpt does not specify whether the personal guaranty is revocable, prospective Dryer Vent Squad franchisees should seek clarification from the franchisor regarding the terms of the guaranty, specifically whether it can be revoked or terminated under certain conditions. Understanding the circumstances under which the guaranty can be released or terminated is crucial for assessing the personal financial risk associated with the franchise.
