What This Means (2024 FDD)
The 2024 Dryer Vent Squad Franchise Disclosure Document includes an amendment specific to franchisees in Washington state. This amendment addresses dispute resolution, but it does not specify whether mediation is binding. It states that for any arbitration or mediation involving a franchise purchased in Washington, the location of the proceedings will be in Washington, or a place mutually agreed upon, or as determined by the arbitrator or mediator. The amendment also clarifies that if litigation is not precluded by the franchise agreement, a franchisee can bring an action related to the sale of franchises or violations of the Washington Franchise Investment Protection Act in Washington.
Because the FDD does not state whether the mediation process is binding, prospective Dryer Vent Squad franchisees should clarify this point with the franchisor before signing the agreement. Understanding whether mediation is binding is crucial, as it determines whether the franchisee is obligated to accept the outcome of the mediation process or can pursue further legal action.
It is important for prospective franchisees to understand the dispute resolution processes, including mediation and arbitration, as these processes can significantly impact how disputes with the franchisor are handled. Clarifying whether mediation is binding is a key part of this understanding and can help franchisees make informed decisions about entering into the franchise agreement.
