What This Means (2024 FDD)

According to the 2024 Dryer Vent Squad FDD, Minnesota franchisees are given specific rights regarding termination. The FDD states that Dryer Vent Squad will comply with Minnesota Statute Section 80C.14, Subdivisions 3, 4, and 5, which mandates that franchisees in Minnesota must be given 90 days' notice of termination, with 60 days to cure the default, except in certain specified cases.

This means that if Dryer Vent Squad decides to terminate a franchise agreement in Minnesota (outside of the aforementioned 'specified cases'), the franchisee is entitled to a 90-day notice period. Within this period, the franchisee has 60 days to correct the issues that led to the termination notice, effectively 'curing' the default. If the franchisee successfully addresses the issues within this 60-day cure period, Dryer Vent Squad may be obligated to withdraw the termination notice.

This amendment provides significant protection to Dryer Vent Squad franchisees in Minnesota, ensuring they have a reasonable opportunity to rectify any breaches of the franchise agreement before termination occurs. This is more generous than some states, where cure periods can be as short as 30 days, or non-existent for certain types of defaults. Prospective franchisees should carefully review the specific conditions under which the cure period applies, as there may be exceptions where the 60-day cure period does not apply.
