What This Means (2024 FDD)

The 2024 Dryer Vent Squad Franchise Disclosure Document includes an amendment specific to Washington State, addressing arbitration and mediation. For franchises purchased in Washington, any arbitration or mediation must occur within the state of Washington or at a location mutually agreed upon by both parties at the time of the arbitration or mediation. If the parties cannot agree, the arbitrator or mediator will determine the location during the arbitration or mediation proceedings. This amendment ensures that Washington franchisees have a local venue for dispute resolution, providing a more accessible and potentially less costly process.

Additionally, the Washington Franchise Investment Protection Act and relevant court decisions may supersede the franchise agreement, particularly concerning termination and renewal. This means that certain provisions in the franchise agreement might not be enforceable if they conflict with Washington state law.

Furthermore, if litigation is not precluded by the franchise agreement, a franchisee has the right to bring legal action in Washington if the dispute arises from the sale of franchises or a violation of the Washington Franchise Investment Protection Act. This offers franchisees an additional avenue for resolving disputes within their home state, providing them with legal recourse and protection under Washington law.
