What rights are Dq Treat franchisees granted regarding Punchh Analytics during the term of the agreement?

Punchh will provide and make available to Customer certain data, analytics or information through the Platform and Services ("Punchh Analytics"). All Punchh Analytics are provided and made available subject to the terms of this Agreement. As between Punchh and Customer, all Punchh Analytics (to the extent such Punchh Analytics do not include Customer Data) will be owned by Punchh. During the Term of this Agreement and subject to the provisions thereof, Punchh grants Customer and Authorized Users the right to access the Punchh Analytics on the Platform and use those Punchh Analytics solely for Customer's own internal business purposes in connection with the Promotional Programs with which the Punchh Analytics is provided. Customer is not granted any other rights in the Punchh Analytics and will not otherwise use or share any Punchh Analytics other than as expressly permitted herein.

What This Means (2025 FDD)
According to Dq Treat's 2025 Franchise Disclosure Document, Punchh will provide Dq Treat customers with data, analytics, and information through its platform and services, referred to as "Punchh Analytics." All Punchh Analytics are subject to the agreement's terms.
During the agreement's term, Dq Treat franchisees and their authorized users have the right to access Punchh Analytics on the platform. They can use these analytics solely for their internal business purposes related to the promotional programs for which the analytics are provided. This access is subject to the agreement's provisions.
However, Dq Treat franchisees are not granted any other rights in the Punchh Analytics beyond what is expressly permitted in the agreement. They cannot otherwise use or share the analytics, except as specifically allowed. All Punchh Analytics (excluding Customer Data) will be owned by Punchh.
