What This Means (2025 FDD)
According to Dq Treat's 2025 Franchise Disclosure Document, upon termination or expiration of the PARPay Terms, a Participating Location must discontinue using the Device Software and return all User Documentation, as well as any other property belonging to PAR. Furthermore, the Participating Location is required to confirm their compliance with this requirement in writing if PAR requests it.
This means that if a Dq Treat franchise location's PARPay agreement ends, whether through expiration or termination, the franchisee can no longer use the payment processing software provided by PAR. They must also return all related documentation and any other PAR property. This ensures that the franchisee does not continue to use the software or documentation without proper authorization.
This requirement protects PAR's intellectual property and ensures that Dq Treat franchisees are not using outdated or unauthorized versions of the payment processing software. It is a standard practice in franchising to ensure that franchisees adhere to the terms of their agreements, especially regarding the use of proprietary software and documentation. The written confirmation requirement provides PAR with a means of verifying compliance and addressing any potential misuse of their assets.
