Upon termination or expiration of this Agreement, Area Developer shall immediately deliver to Franchisor the Manuals and all other records, files, and any instructions containing Dog Haus Confidential Information which are in Area Developer's possession and all copies thereof (all of which are acknowledged to be the property of Franchisor).

What This Means (2025 FDD)
According to Dog Haus's 2025 Franchise Disclosure Document, upon termination or expiration of the Area Development Agreement, the Area Developer must immediately return to Dog Haus the Manuals and all other records, files, and any instructions containing Dog Haus Confidential Information which are in the Area Developer's possession, including all copies. All of these materials are acknowledged to be the property of Dog Haus. This obligation is in place to protect the Dog Haus System, Dog Haus Marks, and Trade Secrets.
Dog Haus defines "Dog Haus Confidential Information" as information not generally known to the public that derives economic value from its secrecy and is subject to reasonable efforts by Dog Haus to maintain its secrecy. This includes databases, relationships between Dog Haus and other companies, knowledge concerning the methods of operation of the Dog Haus Restaurant, and any other information or material considered proprietary by Dog Haus, whether or not designated as confidential. It also includes information in oral, written, graphic, or electronic form which, given the circumstances surrounding its disclosure, would be considered confidential.
This requirement ensures that proprietary information remains within the control of Dog Haus, preventing former Area Developers from using it to compete or otherwise benefit from knowledge gained during their association with the franchise. Failure to comply with this requirement could result in legal action, as Dog Haus asserts that violation of confidentiality provisions could cause irreparable harm and entitle them to injunctive relief and recovery of legal costs.
