What This Means (2025 FDD)
According to Dog Haus's 2025 Franchise Disclosure Document, the Area Development Agreement grants the developer the right to develop and operate a specified number of Dog Haus restaurants within a defined Development Area, subject to Dog Haus's approval. This Development Area can encompass one or more cities, counties, states, or another defined region. During the term of the Area Development Agreement, Dog Haus commits not to operate or grant a license or franchise to any other person to operate a Dog Haus restaurant within the developer's designated Development Area.
This agreement provides the developer with a defined territory in which they have the exclusive right to develop Dog Haus restaurants. This exclusivity is a significant benefit, as it protects the developer from direct competition from other Dog Haus franchisees or company-owned outlets within their designated area. However, this right is contingent upon Dog Haus's approval of each specific location and adherence to the terms of the Area Development Agreement.
It is important to note that this exclusivity is limited to the operation of Dog Haus restaurants. Dog Haus retains the right to develop, own, and operate other businesses, even those that may compete, under different brands and systems. Additionally, Dog Haus reserves the right to sell or distribute Dog Haus branded products through various channels, such as the internet or catering, within or outside the Development Area, without compensating the developer. These reservations highlight the importance of carefully reviewing the terms of the Area Development Agreement to understand the scope and limitations of the granted development rights.
