What is the range of the radius for the Protected Area granted to a Dog Haus franchisee?

You will be granted a protected territory ("Protected Area") of a 1/2 - 5 mile radius from your Franchised Restaurant as described in the Franchise Agreement. Your Protected Area will be designated when you have identified a site for your Franchised Restaurant. Factors that we consider in determining the size of your Protected Area include the demographics, population size, age and income levels, neighboring and adjacent retail tenants, road visibility, traffic patterns, geographical barriers and proximity of other Dog Haus Restaurants or competitors serving the same market area. Provided you are not in default under your Franchise Agreement, we will not own, operate, sell or issue a Franchised Restaurant franchise to another franchisee in your Protected Area. There are no other radius restrictions or minimum population requirements that limit where we can franchise or operate another Franchised Restaurant.

What This Means (2025 FDD)
According to Dog Haus's 2025 Franchise Disclosure Document, franchisees are granted a Protected Area that ranges from 1/2 to 5 miles in radius from their restaurant location. This Protected Area is not established until a site for the franchise has been identified. Dog Haus considers factors such as demographics, population size, income levels, neighboring tenants, road visibility, traffic patterns, geographical barriers, and the proximity of other Dog Haus locations or competitors when determining the size of the Protected Area.
Within this Protected Area, Dog Haus agrees not to open or franchise another Dog Haus restaurant, provided the franchisee is not in default of their Franchise Agreement. However, it is important to note that there are no other radius restrictions or minimum population requirements that would otherwise limit Dog Haus from franchising or operating another restaurant outside of this Protected Area. This means that while franchisees have some territorial protection, Dog Haus retains significant flexibility in expanding its brand nearby.
Dog Haus also retains the right to sell Dog Haus branded products at any location within or outside the Protected Area through various channels, including the internet, mail order catalogs, direct mail marketing, catering, and other distribution methods. They can also market on the internet and use Dog Haus Marks on the internet. Furthermore, Dog Haus reserves the right to deliver and cater, or license other franchisees or third parties to deliver and cater, at any location within or outside of the Protected Area without compensating the franchisee. These stipulations highlight that the Protected Area primarily restricts the physical presence of another Dog Haus restaurant but does not prevent Dog Haus or others from selling or delivering products within that area.
