What This Means (2025 FDD)
According to Dog Haus's 2025 Franchise Disclosure Document, a franchisee is granted a license to use Dog Haus data solely for operating their franchised restaurant. This license is provided at no cost during the term of the Franchise Agreement. The Dog Haus data encompasses all data pertaining to the franchised restaurant, including customer information and data collected in connection with the restaurant's operation, whether uploaded, downloaded, or created using any artificial intelligence program.
However, the franchisee must maintain the Dog Haus data as secret and confidential and cannot make it available to any unauthorized person without Dog Haus's prior written consent, and even then, only in the manner Dog Haus permits. This means a franchisee cannot use the data for purposes outside of running their specific Dog Haus location, such as sharing it with third parties or using it for personal business ventures, without explicit approval from Dog Haus.
Dog Haus retains the right to review and use the Dog Haus data in any manner it deems appropriate without compensating the franchisee. This includes using the data to monitor gross sales, purchases, costs, and expenses, develop chain-wide statistics, develop or remove authorized products, refine existing products, and generally improve chain-wide understanding of the Dog Haus system. The franchisee is required to provide Dog Haus with copies or originals of the data within five days of request, at no cost to Dog Haus, both during the term of the agreement and upon its expiration or termination.
In practical terms, while a Dog Haus franchisee can utilize the data to understand their customers and manage their restaurant effectively, they must be extremely careful about data security and confidentiality. They must also be prepared to share all data with Dog Haus and allow Dog Haus to use it for broader business purposes. This arrangement is typical in franchising, where the franchisor needs access to data from all locations to maintain brand consistency and improve the overall system.
