What This Means (2025 FDD)

According to Dog Haus's 2025 Franchise Disclosure Document, any ideas, concepts, techniques, or materials that a franchisee creates during their time as a franchisee must be promptly disclosed to Dog Haus. These creations, whether or not they are protectable intellectual property, become the exclusive property of Dog Haus. They are considered part of the Dog Haus franchise system as a work made for hire, without any compensation to the franchisee. This means that Dog Haus owns all rights to these creations and can use them as they see fit within the franchise system.

This requirement has significant implications for prospective Dog Haus franchisees. It means that any innovation or improvement a franchisee develops for their Dog Haus restaurant, even if it significantly boosts efficiency or customer satisfaction, automatically belongs to the franchisor. The franchisee will not receive any direct financial benefit or recognition for these contributions beyond the potential indirect benefits of system-wide improvements.

This type of clause is relatively common in franchising, as franchisors aim to maintain uniformity and control over their brand and system. However, it is crucial for franchisees to understand that they are essentially giving up ownership of any intellectual property they develop within the context of the franchise. Franchisees should consider this carefully, especially if they have a strong entrepreneurial spirit and a desire to innovate and own their creations.

Prospective franchisees should discuss this provision with existing Dog Haus franchisees to understand how it works in practice and whether it has any impact on their operations or morale. Additionally, they may want to seek legal advice to fully understand the implications of assigning ownership of their ideas to Dog Haus.
