What This Means (2025 FDD)

According to the 2025 Dog Haus Franchise Disclosure Document, franchisees are obligated to protect the Dog Haus System, Marks, Trade Secrets, and associated goodwill. As part of this obligation, the franchise agreement stipulates that franchisees must not deviate from the prescribed methods, standards, and specifications set by Dog Haus without prior written consent. More specifically, franchisees must avoid operating in any manner that reflects adversely on the Dog Haus Marks. This requirement ensures that franchisees maintain brand consistency and uphold the reputation of the Dog Haus brand.

This provision means that a Dog Haus franchisee must adhere strictly to the operational guidelines and brand standards established by Dog Haus. Any deviation from these standards that could potentially harm the brand's image is prohibited. This includes, but is not limited to, maintaining the quality of products, cleanliness of the restaurant, and customer service standards.

Failure to comply with these standards can lead to consequences, as outlined in Section 16.2.9 of the franchise agreement. If a franchisee materially misuses the Dog Haus Marks, impairs the associated goodwill, or takes any action that reflects unfavorably on the restaurant's operation or the Dog Haus chain in general, Dog Haus has grounds for terminating the franchise agreement. This underscores the importance of adhering to the franchisor's standards and protecting the brand's reputation.

This type of clause is common in franchise agreements to ensure brand uniformity and protect the franchisor's intellectual property. Prospective franchisees should carefully review the operational manual and understand the specific standards they must adhere to in order to avoid any actions that could be deemed detrimental to the Dog Haus brand.
