What This Means (2025 FDD)
According to Dog Haus's 2025 Franchise Disclosure Document, the specific number of Dog Haus Restaurants an Area Developer is obligated to open can be found in Exhibit A, which outlines the Development Schedule. The "Minimum Development Obligation" is defined as the Area Developer's responsibility to construct, equip, open, and operate a cumulative number of Dog Haus Restaurants within the Development Area, as detailed in Exhibit A for each Development Period.
The Area Developer must adhere to the Development Schedule by opening the required number of Dog Haus Restaurants within each specified Development Period. Failure to meet these obligations constitutes a default under the Area Development Agreement, potentially leading to termination of the agreement, unless the failure is due to an event of Force Majeure, which may allow for an extension.
If an Area Developer ceases to operate a Dog Haus Restaurant, they are required to develop a replacement restaurant to fulfill their obligation to maintain the required number of open and operating Dog Haus Restaurants at the end of each Development Period. This replacement restaurant must be opened within twelve months of the closure of the original restaurant. The Area Developer's obligation to open a certain number of Dog Haus restaurants is a critical component of the agreement, with specific details outlined in Exhibit A of the FDD.
