When does a Dog Haus Area Developer sign the Franchise Agreement for their first Franchised Restaurant?

You will sign an Area Development Agreement (Exhibit B), that will describe your development area and your development schedule and obligations. You and we will determine the Development Area and the number of Franchised Restaurants that you will develop and operate before you sign your Area Development Agreement. You must sign a separate Franchise Agreement for each Franchised Restaurant that you will open under the Area Development Agreement. The Franchise Agreement for your first Franchised Restaurant will be in the form attached as Exhibit A to this Disclosure Document and must be signed when you sign your Area Development Agreement. The Franchise Agreements you will sign for your additional Franchised Restaurants will be our then-current form of Franchise Agreement that we are then offering to new franchisees, which may contain terms and conditions that are materially different from our current Franchise Agreement attached as Exhibit A to this Disclosure Document. You will sign our then-current form of Franchise Agreement for each Franchised Restaurant that you will develop after we accept the site for each Franchised Restaurant.

What This Means (2025 FDD)
According to Dog Haus's 2025 Franchise Disclosure Document, an Area Developer must sign a Franchise Agreement for their first Franchised Restaurant when they sign the Area Development Agreement. The Franchise Agreement for the first restaurant is in the form attached as Exhibit A to the FDD.
This means that before an Area Developer can begin developing multiple Dog Haus locations within their designated territory, they must commit to opening and operating their first location under the terms of the standard Franchise Agreement. This ensures that Area Developers are not just selling franchises but are also invested in the brand as owner-operators.
For subsequent Dog Haus restaurants developed under the Area Development Agreement, the Area Developer will sign the then-current form of the Franchise Agreement that Dog Haus is offering to new franchisees. These future agreements may contain terms and conditions that are materially different from the initial Franchise Agreement. The Area Developer will sign the current form of the Franchise Agreement after Dog Haus accepts the site for each Franchised Restaurant.
