For additional Franchised Restaurants developed under the Dog Haus Area Development Agreement, what form of Franchise Agreement will be used?

Dog_Haus Franchise · 2025 FDD

Answer from 2025 FDD Document

You must sign a separate Franchise Agreement for each Franchised Restaurant that you will open under the Area Development Agreement. The Franchise Agreement for your first Franchised Restaurant will be in the form attached as Exhibit A to this Disclosure Document and must be signed when you sign your Area Development Agreement. The Franchise Agreements you will sign for your additional Franchised Restaurants will be our then-current form of Franchise Agreement that we are then offering to new franchisees, which may contain terms and conditions that are materially different from our current Franchise Agreement attached as Exhibit A to this Disclosure Document. You will sign our then-current form of Franchise Agreement for each Franchised Restaurant that you will develop after we accept the site for each Franchised Restaurant.

What This Means (2025 FDD)

According to Dog Haus's 2025 Franchise Disclosure Document, franchisees who sign an Area Development Agreement and develop additional Dog Haus restaurants will use the then-current form of the Franchise Agreement that Dog Haus is offering to new franchisees at that time. This agreement may have terms and conditions that differ significantly from the initial Franchise Agreement (Exhibit A). This agreement will be signed after Dog Haus accepts the site for each new franchised restaurant.

This means that the terms under which a Dog Haus area developer operates could change over time as they open new locations. While the initial agreement is set, subsequent locations will be governed by the franchise agreement currently in use, which could include different fees, obligations, or operational requirements. This is a fairly common practice in franchising, as franchisors update their agreements to reflect changes in the market, legal requirements, or the brand's evolution.

Prospective Dog Haus area developers should carefully consider this aspect, as it introduces an element of uncertainty. It would be prudent to discuss with Dog Haus the potential nature and extent of changes that could be incorporated in future franchise agreements. Understanding the factors that drive these changes and having some insight into Dog Haus's long-term vision can help area developers better prepare for and adapt to evolving terms and conditions as they expand their Dog Haus footprint.
