Is there a fee for additional training programs offered by Devon Creek?

- 7.3 Additional Training.
Franchisor may offer mandatory and/or optional additional training programs from time to time.
If required by Franchisor, Franchisee, or Franchisee's Principal(s), shall participate in on-going training and/or a national business meeting or systemwide convention, for up to five (5) days per year.
Franchisor reserves the right to impose a reasonable fee for all additional training programs.
Franchisee shall be responsible for any and all incidental expenses incurred by Franchisee or Franchisee's personnel in connection with additional training or attendance at Franchisor's national business meeting or annual convention, including, without limitation, costs of travel, lodging, meals and wages.
Franchisee's failure to attend and/or complete mandatory additional training or failure to attend Franchisor's national business meeting or annual convention is a default of this Agreement.
Franchise shall be responsible for the annual convention fee whether or not Franchisee attends the annual conference.
Franchisee or Franchisee's principal(s) shall be required to obtain any missed mandatory additional training at a location Franchisor designates.
Franchisee shall pay all costs and expenses for such additional missed training, including but not limited to, tuition at the then-current rate and any and all transportation, meals and lodging of Franchisee, Franchisee's principal(s) and Franchisor's training personnel.
Franchisee shall pay to Franchisor any incurred expenses by Franchisor's training personnel within ten (10) days of Franchisor's billing thereof to Franchisee via ACH.

What This Means (2024 FDD)
According to Devon Creek's 2024 Franchise Disclosure Document, Devon Creek may offer additional training programs that are either mandatory or optional. If Devon Creek requires franchisees or their principals to attend ongoing training, a national business meeting, or a systemwide convention, the duration is up to five days annually. Devon Creek retains the right to charge a reasonable fee for these additional training programs. Franchisees are responsible for all incidental expenses related to additional training or attending the national meeting or convention, including travel, lodging, meals, and wages.
Failure to attend or complete mandatory additional training or the national business meeting constitutes a default of the Franchise Agreement. The franchisee is also responsible for the annual convention fee, regardless of attendance. If mandatory additional training is missed, the franchisee or their principals must obtain the training at a location designated by Devon Creek.
The franchisee is responsible for all costs associated with missed training, including tuition at the current rate, transportation, meals, and lodging for both the franchisee/principals and Devon Creek's training personnel. Devon Creek will bill the franchisee for any expenses incurred by their training personnel, and the franchisee must pay these within ten days via ACH.
