What This Means (2024 FDD)
According to Devon Creek's 2024 Franchise Disclosure Document, if a General Manager is unable to continue in their role, the franchisee must notify Devon Creek and designate a replacement within 30 days. This replacement manager must meet the same qualifications as the original manager.
Specifically, the replacement General Manager must meet Devon Creek's standards and criteria as outlined in the manual or in writing, and must be acceptable to Devon Creek at their discretion. The replacement manager is required to devote their full time and best efforts to managing the Devon Creek franchise, and cannot engage in other business activities without Devon Creek's consent.
Furthermore, the replacement General Manager must also satisfy the training requirements detailed in Article 7 of the franchise agreement. Until a suitable replacement is found, the franchisee is responsible for providing interim management that adheres to the terms of the agreement. This ensures that the Devon Creek franchise maintains consistent operational standards even during a management transition.
