1. Pre-Opening Obligations

Before you open your Franchised Business, we will:

  • a. designate the boundaries of your territory (Franchise Agreement, Section 8.1).
  • b. provide the Devon Creek Operations Manual and other manuals and training aids we designate for use in the operation of your Devon Creek Franchised Outlet, as they may be revised from time to time (Franchise Agreement, Section 10.2).
  • c. provide a written list of specifications/names for approved suppliers for franchisee's business including and not limited to; equipment, signage, supplies and products that will be required to open the Franchised Business. (Franchise Agreement, Section 10.3).
  • d. provide you with pre-opening training of four (4 weeks) for the franchisee and up to and one additional person
  • e. provide training at your onsite location upon the franchisee's commencement of business operations. The training will be provided a minimum of forty (40) hours. We will determine, in our sole discretion, whether you satisfactorily complete the initial training (Franchise Agreement, Section 7.1).
  • f. provide you with samples or digital artwork of advertising and promotional materials for your initial marketing activities (Franchise Agreement, Section 10.4).

According to Devon Creek's 2024 Franchise Disclosure Document, initial training involves both classroom instruction and hands-on training. Devon Creek provides pre-opening training of four weeks for the franchisee and one additional person. Additionally, Devon Creek provides training at the franchisee's onsite location upon commencement of business operations, for a minimum of 40 hours.

The training materials for Devon Creek consist of videos, reference books, worksheets, and forms and/or the Operations Manual. Franchisees may not commence operation of the Franchised Business unless and until Devon Creek determines that they have successfully completed the Initial Management Training Program.

The cost of instructors, training materials, and up to two days of on-site training are included in the Initial Franchise Fee. However, franchisees are responsible for all travel and personal expenses, including transportation and most meals, for themselves and their personnel. There is a fee of $400 per person per day per trainer for initial training provided to any additional or replacement trainees.
