What This Means (2024 FDD)
According to the 2024 Devon Creek Franchise Disclosure Document, a franchisee is responsible for covering the expenses incurred by Devon Creek's training personnel. These expenses must be paid within ten days of the franchisee receiving a bill from Devon Creek, and the payment is to be made via ACH (Automated Clearing House). This payment structure applies to additional missed training that the franchisee or their principals are required to obtain at a location designated by Devon Creek. The franchisee is responsible for all costs and expenses related to this additional training, including tuition at the then-current rate, transportation, meals, and lodging for both the franchisee/principals and Devon Creek's training personnel.
This payment obligation is in addition to the franchisee's responsibility for incidental expenses related to additional training programs or attendance at Devon Creek's national business meeting or annual convention. These incidental expenses include travel, lodging, meals, and wages for the franchisee and their personnel. Devon Creek also reserves the right to impose a reasonable fee for all additional training programs.
In the event that a franchisee requests on-site remedial training and assistance within their territory, they will be required to pay a per diem fee for the services of Devon Creek's trained representatives, as well as cover their costs of travel, lodging, and meals. However, consultation and assistance provided by Devon Creek, either in person or via phone, video conference, email, or postal service, is furnished at no charge to the franchisee unless it is provided in the franchisee's territory under the conditions described in Section 7.4.
