Answer from 2024 FDD Document

You may only offer and sell the products and services that are part of the System, and the services and products which we incorporate into the System in the future. You may only offer products and services that we have previously approved and for which you are qualified to provide. Franchisees will be required to hold any licenses required at the local, state or federal levels to apply pesticides or other chemicals.

You may not use our Marks for any other business, and you may not conduct any other business at or through your Franchised Business operations or office. You cannot engage in any other business that competes with your Franchised Business, with us or our affiliates, or with Devon Creek Franchise locations owned by other franchisees, whether such business is inside or outside of the Territory.

What This Means (2024 FDD)

According to the 2024 Devon Creek Franchise Disclosure Document, a franchisee is restricted from conducting any other business at or through their Devon Creek franchised business operations or office. Franchisees are only permitted to offer and sell products and services that are part of the Devon Creek system, including any future services and products incorporated into the system that have been previously approved and for which the franchisee is qualified to provide.

Devon Creek franchisees are prohibited from using the Devon Creek marks for any business other than the franchised Devon Creek business. Furthermore, franchisees cannot engage in any business that competes with their Devon Creek franchised business, Devon Creek itself, its affiliates, or other Devon Creek franchise locations, regardless of whether the competing business is located inside or outside of their designated territory.

This restriction ensures that franchisees focus solely on the Devon Creek business and do not divert resources or attention to other ventures that could potentially conflict with or detract from the success of the Devon Creek franchise. This type of restriction is common in franchising to maintain brand consistency and prevent competition among franchisees and the franchisor.
