Does Devon Creek claim copyrights on materials used in the System?

According to the 2024 Devon Creek Franchise Disclosure Document, Devon Creek IP, LLC, or its successor, owns the Marks. Devon Creek claims copyrights on certain material used in the System. This includes, but is not limited to, its website, documents, advertisements, promotional materials, and the Manual, whether or not Devon Creek has filed for copyrights with the U.S. Copyright Office. These copyrights, along with trade secrets, service marks, trade dress, and proprietary systems, are collectively referred to as the "Intellectual Property."

As a Devon Creek franchisee, you must acknowledge that Devon Creek owns all rights to the Intellectual Property. You cannot take any actions that would negatively affect Devon Creek's rights to its Intellectual Property. The franchise agreement does not grant you any rights to Devon Creek's service marks, trademarks, trade names, trade dress, logos, or copyrights, except the right to use them in accordance with the agreement for operating your franchised business.

Upon termination or expiration of the franchise agreement, your rights to use Devon Creek's Intellectual Property will immediately terminate. You must cease using the Marks, copyrighted material, or any other intellectual property associated with the Devon Creek System. This includes discontinuing the use of all signs, billboards, advertising materials, displays, stationery, and forms that display the Marks.
