What This Means (2024 FDD)

According to the 2024 Devon Creek Franchise Disclosure Document, Devon Creek IP, LLC, or its successor, claims copyrights on certain material used in the Devon Creek system. This includes, but is not limited to, its website, documents, advertisements, promotional materials, and the Manual, regardless of whether Devon Creek has filed for copyrights with the U.S. Copyright Office. These copyrights, along with Devon Creek's trademarks, trade secrets, service marks, and trade dress, are collectively referred to as the "Intellectual Property."

This means that as a Devon Creek franchisee, you are granted the right to use the Intellectual Property, including website content, only in accordance with the terms and conditions of the Franchise Agreement for operating the franchised business. You do not gain any ownership or proprietary rights to Devon Creek's website or its contents beyond this limited usage. Upon termination of the Franchise Agreement, your right to use this Intellectual Property, including the website content, immediately ceases.

This policy is typical in franchising, as franchisors need to protect their brand identity and marketing materials. As a franchisee, you must adhere to Devon Creek's guidelines for using the website and other copyrighted materials to avoid any potential legal issues. It is important to understand the scope of your usage rights and restrictions as outlined in the Franchise Agreement to ensure compliance and maintain a good relationship with Devon Creek.
