What This Means (2024 FDD)
According to Desi District's 2024 Franchise Disclosure Document, Desi District has the right to utilize marketing materials developed by or for its franchisees. Specifically, Desi District is granted an unlimited, perpetual, royalty-free license to use any marketing materials or campaigns that a franchisee develops.
This means that if a franchisee creates a successful marketing campaign, Desi District can adopt and use that campaign across the entire franchise system without having to compensate the franchisee. This clause encourages franchisees to innovate and develop effective marketing strategies, knowing that successful ideas could be implemented system-wide.
However, franchisees must obtain approval from Desi District for all marketing, advertising, and public relations activities before implementation. This includes in-store marketing materials, websites, online advertising, social media presence, and sponsorships. Desi District also has the option to manage all social media accounts on behalf of the system or allow franchisees to operate their own accounts, subject to compliance with system standards and social media policies. This ensures brand consistency and quality control across all marketing efforts.
This arrangement benefits Desi District by allowing it to leverage the creativity and marketing expertise of its franchisees, while also maintaining control over the brand's image and marketing strategies. Franchisees benefit by having their successful campaigns potentially adopted system-wide, increasing brand recognition and potentially driving more business to their location.
