What This Means (2024 FDD)
According to Desi District's 2024 Franchise Disclosure Document, Desi District Franchise Group has the authority to vary or waive system standards for individual Desi District franchises. This flexibility is allowed due to specific conditions that may affect a particular location or group of franchises. These conditions include the unique characteristics of the site, population density, business potential, the population of the trade area, existing business practices, and applicable laws or regulations. Any other condition relevant to the performance of a franchise or group of franchises may also be considered.
This provision in the franchise agreement allows Desi District to adapt its standard operating procedures to suit the specific needs and challenges of different locations. For example, a Desi District restaurant in a densely populated urban area might have different operational requirements than one in a suburban or rural setting. Similarly, local regulations or business practices could necessitate adjustments to the standard franchise model.
It is important to note that while Desi District Franchise Group can make these variations or waivers, the franchisee does not have the same entitlement. This means that a franchisee cannot unilaterally request a change to the system standards. Any variations are at the discretion of Desi District Franchise Group. This clause provides Desi District with the ability to respond to local conditions while maintaining overall brand consistency and operational standards across the franchise system.
Prospective franchisees should understand that while some flexibility exists, they cannot assume they will be granted a waiver or variation of system standards. Franchisees should discuss any potential needs for variation with Desi District Franchise Group during the due diligence process to understand the likelihood of obtaining such accommodations.
