Us or our Affiliates as Supplier

Our affiliate, TAR Distributors, Inc. is currently a supplier of merchandise, apparel, food product and goods that you must purchase, and we reserve the right to be a supplier (or the sole supplier) of goods or services in the future.

Ownership of Suppliers

Outside of your requirement to purchase some of the food product and retail items from our Affiliate, none of our officers own any interest in a supplier to our franchisees.

Alternative Suppliers

If you want to use a supplier that is not on our list of approved suppliers, you must request our approval in writing. We will grant or revoke approvals of suppliers based on criteria appropriate to the situation, which may include evaluations of the supplier's capacity, quality, financial stability, reputation, and reliability; inspections; product testing, and performance reviews. Our criteria for approving suppliers are not available to you. We permit you to contract with alternative suppliers who meet our criteria only if you request our approval in writing, and we grant approval. There is no fee for us to review or approve an alternate supplier.

What This Means (2024 FDD)

According to Desi District's 2024 Franchise Disclosure Document, franchisees are required to purchase or lease point-of-sale (POS) software and hardware, as well as related software and hardware, from sources specified by Desi District. This mandate is part of a broader set of restrictions Desi District imposes on where franchisees can obtain goods, services, and supplies necessary for establishing and operating their business. Desi District maintains the right to mandate purchases from themselves, their designees, or approved suppliers, or according to their specifications.

This requirement has several implications for prospective Desi District franchisees. It limits their ability to shop around for the best prices or preferred vendors for POS systems. While this ensures brand consistency and potentially streamlined technical support, it may also mean franchisees are subject to pricing and terms dictated by Desi District or its approved vendors. Franchisees do have the option to request approval for alternative suppliers in writing, but Desi District retains the right to grant or revoke such approvals based on their own criteria, which are not disclosed to franchisees.

Desi District estimates that required purchases and leases account for a significant portion of a franchisee's total expenditures, ranging from 50% to 80% for both establishing and operating the business. This high percentage underscores the importance of understanding these restrictions and their potential financial impact. Desi District also notes that they may receive payments from designated suppliers based on franchisee purchases, indicating a potential revenue stream for the franchisor from these mandated relationships.

Prospective franchisees should carefully consider these restrictions and evaluate the POS systems offered by Desi District or its approved vendors. It would be prudent to inquire about the costs, features, and support associated with these systems to determine if they align with their business needs and budget. Additionally, understanding the process for requesting alternative supplier approval and the criteria Desi District uses for evaluation is crucial for maintaining some level of purchasing flexibility.
