What This Means (2024 FDD)
According to Desi District's 2024 Franchise Disclosure Document, franchisees are licensed to use customer data generated by their business without incurring a direct charge from Desi District. Desi District maintains ownership of all customer and non-public data, but grants the franchisee a license to use this data specifically for operating their Desi District franchise during the term of the Franchise Agreement. This means franchisees can leverage customer information to improve their business operations without paying extra fees for data access. However, this license is contingent upon the franchisee's adherence to the terms of the agreement.
This arrangement allows Desi District to retain control over valuable customer data while empowering franchisees to utilize it for local business development. It is a fairly common practice in franchising for the franchisor to own the customer data, as it contributes to the overall brand equity and strategic decision-making at the corporate level. By licensing the data back to the franchisee, Desi District ensures that franchisees have the necessary resources to effectively market and manage their individual locations.
It's important to note that while the license is granted without charge, the franchisee's use of customer data is limited to activities directly related to their Desi District business. Any other use of the data would likely be a breach of the agreement. Additionally, the franchisee must maintain the confidentiality of this information, as outlined in the FDD. Upon termination of the Franchise Agreement, the franchisee's right to use the data ceases, and the data remains the property of Desi District.
