What This Means (2024 FDD)
According to Desi District's 2024 Franchise Disclosure Document, the franchisee is solely responsible for the actions of their personnel. This means that the franchisee is liable for anything their employees do while working at the Desi District business.
This responsibility extends to all aspects of employment, including recruiting, hiring, training, scheduling, supervising, compensation, and termination. Desi District Franchise Group may set minimum qualifications for categories of employees, but the franchisee maintains control over employment terms and conditions. The FDD clarifies that the franchisee and Desi District are not joint employers, and the franchisee's employees are not considered agents or employees of Desi District Franchise Group.
To ensure clarity, Desi District requires franchisees and their employees to sign an acknowledgment form stating that the franchisee is the employee's sole employer and that the franchisee will use its legal name on all employment-related documents, avoiding the use of Desi District's marks on these documents. This reinforces the separation of employment responsibilities and liabilities between the franchisor and the franchisee.
This arrangement is typical in franchising, where franchisees operate as independent business owners. Prospective Desi District franchisees should understand that they bear the full responsibility for managing and overseeing their employees' conduct and ensuring compliance with all applicable laws and regulations.
