Does Desi District have any registered copyrights?

According to Desi District's 2024 Franchise Disclosure Document, the franchisor licenses a principal trademark to franchisees. This trademark is owned by Desi District, LLC, which is an affiliate of the franchisor. The trademark is registered on the Principal Register of the United States Patent and Trademark Office.

This registration provides legal protection for the Desi District brand name and logo. As a franchisee, you are granted the right to use this trademark in the operation of your franchise, but you do not own the trademark itself. All goodwill associated with the use of the marks, including any goodwill arising from the franchisee's operation of the business, accrues to the benefit of Desi District Franchise Group.

Desi District retains the right to add, modify, or discontinue any marks used under the system, and franchisees must comply with these changes at their own expense. Franchisees are required to use only the trademarks specified by Desi District and in the manner required by the franchisor. If a franchisee is an entity, it cannot use "Desi District" or any confusingly similar words in its legal name.

Desi District will defend a franchisee against any action by a third party alleging infringement if the franchisee has used the marks in accordance with the franchise agreement. The franchisor will also indemnify the franchisee for expenses and damages if the action is resolved unfavorably to the franchisee. Franchisees must promptly notify Desi District if they become aware of any possible infringement of a mark by a third party, and Desi District has the exclusive right to control any prosecution or defense of any action related to possible infringement.
