What This Means (2024 FDD)
According to Desi District's 2024 Franchise Disclosure Document, Desi District Franchise Group has the right to add, modify, or discontinue any Marks used within the franchise system. If Desi District makes such a change to its Marks, the franchisee is obligated to comply with the change within a reasonable time frame.
Importantly, the franchisee bears the expense of complying with these changes. This could involve updating signage, marketing materials, menus, or other branded items to reflect the new Marks. The FDD does not define what constitutes a 'reasonable time,' leaving room for interpretation based on the specific changes and circumstances.
This clause ensures that Desi District maintains control over its brand identity and can adapt its Marks as needed. However, it also places a financial burden on the franchisee to keep up with these changes. Prospective franchisees should factor in the potential costs of rebranding when evaluating the Desi District franchise opportunity and should seek clarification from Desi District regarding the frequency and scope of potential Mark changes.
