What This Means (2024 FDD)
According to Desi District's 2024 Franchise Disclosure Document, Desi District Franchise Group can provide binding notice of changes to System Standards via electronic mail or other electronic communication. This modifies the standard notice requirements outlined in Section 18.9 of the franchise agreement, which typically require written notices delivered personally, by registered or certified U.S. mail with return receipt, or via overnight courier.
This means that Desi District franchisees may receive official updates and changes to the System Standards, which govern many aspects of the business, through email or other electronic means. Franchisees must regularly monitor their electronic communications to stay informed of these changes, as they are considered binding once sent by Desi District.
This approach offers Desi District a more efficient and immediate way to communicate important updates compared to traditional mail. However, it places the onus on the franchisee to ensure they have reliable access to electronic communication and to promptly review any notices received. Franchisees should confirm what specific methods of electronic communication Desi District will use and how they can ensure they receive and acknowledge these notices to avoid any potential misunderstandings or compliance issues.
