What This Means (2024 FDD)
According to the 2024 Desi District Franchise Disclosure Document, franchisees are not charged a fee to license customer data. Desi District owns all customer and non-public data generated by the business. However, Desi District licenses this data back to the franchisee for use in connection with their Desi District business during the term of the Franchise Agreement at no charge.
This arrangement means that while franchisees can utilize customer data to operate and grow their business, they do not own the data outright and cannot use it for purposes outside of the Desi District franchise. This is a common practice in franchising, where the franchisor retains ownership of intellectual property and data generated within the system.
Upon termination of the franchise agreement, the franchisee's right to use the customer data also ends, as the license is only valid during the term of the agreement. This underscores the importance of understanding the terms of data usage and ownership within the franchise agreement, as it directly impacts the franchisee's ability to leverage customer information.
