What This Means (2024 FDD)

According to Desi District's 2024 Franchise Disclosure Document, Desi District Franchise Group is not required to inspect a franchisee's construction or remodeling progress. However, the franchisee must construct or remodel the location in accordance with Desi District's System Standards. Franchisees are also required to obtain Desi District's approval of their plans before beginning any construction or remodeling work.

While Desi District retains the right to inspect the construction or remodeling progress at any reasonable time, they are not obligated to do so. This means the franchisee bears the primary responsibility for ensuring the construction or remodeling meets Desi District's standards and all applicable regulations. Desi District's inspection and approval to open the Business is not a representation or a warranty that the Business has been constructed in accordance with any architectural, engineering, or legal standards.

This places the onus on the franchisee to manage the construction or remodeling process diligently and to seek expert advice on architectural, engineering, and legal matters. The franchisee cannot rely on information or opinions provided by Desi District or its representatives regarding these matters, and Desi District assumes no liability in this regard. This is a common practice in franchising, where franchisees are generally responsible for the build-out of their locations according to the franchisor's specifications.
