What This Means (2024 FDD)
According to Desi District's 2024 Franchise Disclosure Document, Desi District Franchise Group has the right to delegate its duties or obligations under the Franchise Agreement to either an affiliate or a third party.
This means that Desi District can assign its responsibilities, such as providing support or enforcing standards, to another entity. For a prospective franchisee, this could mean dealing with a different company or individual than originally anticipated. It's important to recognize that the franchisee has no control over this delegation and must accept the new party as if it were Desi District itself.
While this clause provides flexibility for Desi District, it introduces uncertainty for the franchisee. The franchisee should be aware that the quality and nature of support and oversight could change if duties are delegated. It is a fairly standard practice in franchising for franchisors to retain the right to assign agreements, as it allows them to restructure or sell the franchise system without needing consent from each franchisee.
